1. Introduction

Welcome to MovingBox.io ("Company," "we," "us," or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MovingBox.io, governing your access to and use of our reusable green moving box rental and purchase services (the "Services"). By accessing or using our website (www.movingbox.io), mobile application, or Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Services.

2. Acceptance of Terms

By creating an account, placing an order, or using the Services, you affirm that:

  • You are at least 18 years old and legally competent to enter into binding agreements under Kentucky law (KRS § 381.060).
  • You will comply with all applicable federal, state, and local laws, including but not limited to the Kentucky Consumer Protection Act (KRS § 367.110 et seq.) and the Kentucky Uniform Commercial Code (KRS Chapter 355).
  • You consent to electronic communications and agree that all agreements, notices, and disclosures provided electronically satisfy legal requirements.

3. User Responsibilities

3.1 Proper Use of Services

  • Use boxes solely for their intended purpose: moving and/or storage of non-hazardous household or commercial items.
  • Prohibited uses include, but are not limited to:
    • Transporting hazardous materials (e.g., chemicals, explosives) as defined by Kentucky Revised Statutes (KRS § 224.1-010).
    • Subleasing, reselling, or modifying boxes without written consent.
    • Overloading boxes beyond the 75-pound weight limit.

3.2 Care and Maintenance

  • Return boxes in clean, undamaged condition, free of debris, adhesives, or alterations.
  • Avoid exposing boxes to extreme temperatures, sharp objects, or prolonged moisture.
  • Report damages within 24 hours of delivery via support@movingbox.io.

3.3 Compliance with Laws

  • Adhere to all Kentucky waste disposal regulations (KRS Chapter 224) when discarding packing materials.
  • Ensure compliance with the Kentucky Personal Information Protection Act (KRS § 365.732) regarding data shared with MovingBox.io.

4. Rental & Payment Terms

4.1 Rental Period

  • Boxes are rented on a weekly basis. The rental period begins on the delivery date.
  • Extensions require prior approval and incur a prorated fee (1.25x the standard rate).

4.2 Fees and Payment

  • All fees (rental, delivery, deposits) are charged upfront via credit/debit card.
  • A refundable security deposit ($X per box) is required to cover potential damages.
  • Late returns incur daily fees (1.5x the standard rate) after the due date.

4.3 Purchase Options

  • Users may purchase boxes at a one-time cost of $X per box. Purchased boxes are non-refundable.

5. Returns, Damages, and Losses

5.1 Return Process

  • Schedule returns via your account dashboard. Boxes must be empty, folded, and staged for pickup.
  • Failure to return boxes within 7 days post-due date will result in forfeiture of the deposit and a $X replacement fee per box.

5.2 Damage Assessment

  • Minor damage (e.g., scratches): $X repair fee.
  • Major damage (e.g., cracks, broken lids): Full replacement cost ($X per box).
  • Lost/stolen boxes: Replacement cost + a $X administrative fee.

5.3 Dispute Resolution

  • Damage claims must be submitted with photographic evidence within 48 hours of return.

6. Liability Limitations

6.1 Company Liability

  • MovingBox.io is not liable for:
    • Indirect, incidental, or consequential damages (e.g., delays, emotional distress).
    • Damage to items stored in boxes due to User negligence.
    • Service interruptions caused by force majeure events (e.g., natural disasters under KRS § 355.2-615).

6.2 User Liability

  • Users assume full responsibility for:
    • Injuries or property damage caused by misuse of boxes.
    • Violations of Kentucky’s negligence laws (KRS § 411.180).

7. Privacy and Data Protection

  • Our Privacy Policy complies with the Kentucky Personal Information Protection Act (KRS § 365.732) and the FTC’s Safeguards Rule (16 CFR Part 314).
  • Data collected includes payment details, contact information, and usage metrics. We do not sell user data.

8. Dispute Resolution and Governing Law

8.1 Arbitration

  • Disputes shall be resolved through binding arbitration in Jefferson County, Kentucky, under the American Arbitration Association (AAA) rules.

8.2 Governing Law

  • These Terms are governed by Kentucky law (KRS § 446.060). Any litigation must be filed in the Circuit Court of Jefferson County, Kentucky.

8.3 Class Action Waiver

  • Claims must be pursued individually, not as part of a class action.

9. Amendments

  • We reserve the right to modify these Terms. Continued use after updates constitutes acceptance. Major changes will be communicated via email 30 days in advance.

10. Accessibility

  • Our Services comply with the Americans with Disabilities Act (42 U.S.C. § 12182). For accommodation requests, contact support@movingbox.io.

11. Force Majeure

  • We are not liable for delays or failures due to events beyond our control (e.g., pandemics, floods under KRS § 355.2-615).

12. Entire Agreement

  • These Terms supersede all prior agreements. If any provision is deemed unenforceable, the remainder remains valid.

Kentucky-Specific Addendum

  • Waste Disposal: Comply with Kentucky Division of Waste Management guidelines (401 KAR 47:030).
  • Consumer Rights: Complaints may be filed with the Kentucky Attorney General’s Office of Consumer Protection.
